A BILL to amend article six-a, chapter seventeen-a of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
eighteen, relating to expenses incurred as a result of
purchasing a motor vehicle with illegal equipment.
Be it enacted by the Legislature of West Virginia:
That article six-a, chapter seventeen-a of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
eighteen, to read as follows:
ARTICLE 6A. MOTOR VEHICLE DEALERS, DISTRIBUTORS, WHOLESALERS
AND MANUFACTURERS.
§17A-6A-18. Sale of motor vehicles with illegal equipment;
reimbursement of costs and expenses.
Any person who purchases a motor vehicle from any new or
used motor vehicle dealer which contains illegal equipment, andwhich causes the purchaser to incur expenses and costs directly
related to the illegal equipment, shall be entitled to recover
all expenses and costs from the selling motor vehicle dealer.
NOTE: The purpose of this bill is to enable a purchaser of
a motor vehicle to recover all expenses and costs incurred as a
result of the purchase of a motor vehicle with illegal equipment.
